The Otter Guy Boat Tours TERMS & CONDITIONS
By booking or participating in any tour or any related products or services with The Otter Guy, you and any participant agree to these Terms and Conditions.
General Mandatory Acceptance of Agreement
Boating has inherent risks including, but not limited to, serious injury or death. All participants must understand, to the best of their ability, their own limits and decide whether or not they are capable of undertaking in the activity.
Participants under the age of 18
Participants under the age of 18 must be accompanied and supervised by an adult participant authorized to do so by a legal parent or guardian.
Cancellation Policy
The Otter Guy understands that there are a wide variety of circumstances which may lead you to need to cancel a booking. Please notify Luminato at least 24 hours in advance so that we may open up your spot to someone else, this is designed to find a balance between flexibility and fairness.
Inclement Weather & Environmental Conditions
All The Otter Guy experiences are subject to change or cancellation at the sole discretion of The Otter Guy due to inclement weather and/or environmental conditions. Luminato will communicate with you about changes and/or cancellations based on the contact information that you have provided to us during registration. If you have booked on behalf of other participants, it is your responsibility to inform them of any changes which we have communicated with you.
If inclement weather or unsafe environmental conditions happen to occur during an The Otter Guy experience, all participants must get off the water and seek safe shelter immediately. Some examples include, but are not limited to, lightening (within 30 minutes of experience), strong winds (generally over 13knots), heavy fog, heavy rain and/or rough water. In the event of a cancellation or interruption of an The Otter Guy experience due to inclement weather or unsafe environmental conditions the experience may be rescheduled or refunded at the sole discretion of The Otter Guy.
Arriving on Time
Participants agree to arrive on time to begin their The Otter Guy experience. Participants must plan their travel accordingly. The Otter Guy participants must be prepared to forfeit their experience if they arrive late.
Damages
The participants agree to pay for any damages or losses to The Otter Guy equipment incurred by them. If any participant in a group or single booking steals, loses or damages equipment. The Otter Guy has the right to charge the credit card on file for the associated booking for the amount to repair or replace the equipment and time lost.
Images
Participants agree that, while participating in any The Otter Guy experience, images, photos or videos may be taken by others, The Otter Guy or its agents or representatives that may contain or feature you. You consent to any such pictures and/or video being taken and grant perpetual, royalty free, irrevocable license to The Otter Guy staff, contractors, subcontractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions, and the creation of promotional materials), in any medium whatsoever, whether currently known or hereinafter devised, without further obligation or compensation payable to you.
No Responsibility for Theft, Loss or Damage to Personal Belongings
The Otter Guy and The Otter Guy staff are not responsible for theft, loss or damage to any personal belongings. The Otter Guy may provide on land facilities to store personal belongings, however The Otter Guy does not assume any risk or liability for theft, loss or damage. In addition, The Otter Guy provides dry bags for rent. There is always risk of water entering bags and potentially damaging the contents. It is at the sole discretion of any participants to use dry bags and participants assume all risks of doing so. Participants must plan accordingly when deciding which personal belongings to bring to an The Otter Guy experience.
Booking on Behalf of Others
By booking on behalf of other participants, you are deemed the designated contact person for every participant included in that booking. This means that you are responsible for making all payments due in connection with the booking, notifying The Otter Guy of any changes or cancellations requests and keeping your party informed. By booking on behalf of another person or persons you represent and warrant that you have obtained all required consent, acknowledgements and agreement to The Otter Guy’s Terms and Conditions. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and that The Otter Guy will under no circumstance be liable for errors or omissions in the information provided by you to complete a booking. By booking on behalf of another person or persons, you agree to assume all responsibility for equipment lost or damaged by those persons.
Right to Refuse Participations
The Otter Guy reserves the right to refuse participation of any group or individual, for any reason, at any time. In addition, at the sole discretion of The Otter Guy staff, participation may be refused to any group or individual, with or without refund, who are deemed by The Otter Guy staff to be intoxicated, at risk to themselves or others, a risk to the The Otter Guy equipment and/or behave in a fashion which jeopardizes the experience and enjoyment of other participants.
Errors & Omissions
The Otter Guy takes reasonable efforts to provide accurate and up to date information to potential customers and to participants. However, The Otter Guy does not assume any liability for errors and/or omissions in any information provided.
